Terms and Conditions
Our Terms and Conditions were last updated on March 21, 2026.
These Terms and Conditions ("Terms") govern your access to and use of InspectRecord ("the Platform"), operated at app.inspectrecord.ca and app.inspectrecord.com.
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Definitions
● "InspectRecord" / "we" / "us" — the operator of the Platform.
● "Company Admin" — an individual who has registered for a company account and manages equipment, inspection records, templates, and notification settings.
● "Operator" — an individual who completes inspections through the public-facing operator form, on behalf of a subscribing company.
● "Subscription" — a paid or trial plan granting access to the Platform.
● "Content" — data, records, photos, notes, and other information submitted to the Platform.
2. Account Registration
Company Admins must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at legal@inspectrecord.ca if you suspect unauthorized access to your account.
Operator access requires no account registration. Operators access the Platform through a company-specific URL. Companies are responsible for controlling access to their operator URLs.
3. Subscriptions & Trial
3.1 Trial Period
New companies receive a 14-day free trial. No payment information is required to begin a trial. At the end of the trial, access will be suspended until a paid subscription is activated.
3.2 Paid Subscriptions
Subscriptions are billed on a monthly or annual basis as selected at the time of purchase. All fees are in Canadian Dollars (CAD) unless otherwise stated. Subscriptions automatically renew unless cancelled before the renewal date.
3.3 Pricing Changes
We reserve the right to change subscription pricing with 30 days' written notice to Company Admins. Price changes take effect at the next renewal period following the notice.
4. Acceptable Use
You agree not to use the Platform to:
● Submit false, misleading, or fraudulent inspection records
● Violate any applicable law or regulation
● Attempt to gain unauthorised access to any part of the Platform or another company's data
● Transmit malicious code, viruses, or disruptive content
● Reverse-engineer, decompile, or attempt to extract the source code of the Platform
● Resell or sublicense access to the Platform without our written consent
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
5. Intellectual Property
All software, design, trademarks, logos, and content comprising the InspectRecord Platform are the exclusive property of InspectRecord or its licensors. These Terms do not grant you any intellectual property rights in the Platform beyond the limited right to use it as described herein.
You retain full ownership of all Content you submit to the Platform. By submitting Content, you grant InspectRecord a limited, non-exclusive licence to store, process, and display your Content solely for the purpose of providing the Platform to you.
6. Data & Privacy
Your use of the Platform is also governed by our Privacy Policy, available at app.inspectrecord.ca. The Privacy Policy is incorporated into these Terms by reference.
7. Uptime & Service Availability
We aim to provide reliable, continuous access to the Platform. However, we do not guarantee uninterrupted availability. Planned maintenance will be communicated in advance where possible. We are not liable for any losses resulting from service interruptions, whether planned or unplanned.
8. Limitation of Liability
To the maximum extent permitted by applicable law, InspectRecord shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or personal injury, arising from your use of or inability to use the Platform.
Our total liability to you for any claim arising under these Terms shall not exceed the total amount paid by you to InspectRecord in the three months immediately preceding the claim.
InspectRecord is a tool to assist with inspection recordkeeping. It does not replace your obligation to comply with applicable workplace safety legislation and regulations. You remain solely responsible for your organisation's safety compliance.
Where the Platform provides machine-generated translations of inspection content — including checklist questions, section headings, and related text — InspectRecord does not warrant the accuracy, completeness, or fitness for purpose of such translations. Translated content is provided for convenience only. Operators and Company Admins are responsible for ensuring all inspection items are understood correctly before a record is submitted. InspectRecord shall not be liable for any loss, injury, regulatory non-compliance, or other harm arising from reliance on a machine-generated translation.
9. Indemnification
You agree to indemnify and hold harmless InspectRecord and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform, your Content, or your violation of these Terms.
10. Termination
You may cancel your subscription at any time through your account settings or by contacting legal@inspectrecord.ca. Cancellation takes effect at the end of the current billing period.
We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees when due, or if we are required to do so by law. Upon termination, your data will be retained for 90 days and then permanently deleted.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
12. Changes to These Terms
We may update these Terms from time to time. We will notify Company Admins of material changes by email at least 14 days before the changes take effect. Continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the revised Terms.
